Дисертаційну роботу присвячено дослідженню правового регулювання торгових відносин в рамках Європейського Союзу. У роботі здійснено комплексний аналіз розвитку правового регулювання торгових відносин між європейськими державами до утворення Європейських Співтовариств та в рамках Європейського Союзу, змісту і меж застосування свободи руху товарів, яка визначає характер торгових відносин на внутрішньому ринку ЄС, правових основ здійснення торгівлі між Україною і ЄС та перспектив розвитку її правової регламентації.
Ключові слова: Європейський Союз, свобода руху товарів, дискримінаційні заходи, митні бар’єри, кількісні обмеження, лібералізація торгівлі, адаптація законодавства.

Диссертация посвящена исследованию правового регулирования торговых отношений в рамках Европейского Союза. В работе проведен комплексный анализ развития правового регулирования торговых отношений между европейскими странами до образования Европейских Сообществ и в рамках Европейского Союза, содержания и пределов действия свободы движения товаров, которая определяет характер торговых отношений на внутреннем рынке ЕС, правовых основ ведения торговли между Украиной и ЕС, а также перспектив развития ее правовой регламентации.
Ключевые слова: Европейский Союз, свобода движения товаров, дискриминационные мероприятия, таможенные барьеры, количественные ограничения, либерализация торговли, адаптация законодательства.

The dissertation is devoted to the research of the legal regulation of the trade relations within the European Union as well as between the European Union and Ukraine.
The first chapter is devoted to the legal analysis of the development of trade relations between European States. Taking into consideration that the study is limited to the European region it is based on the analysis of the development of the legal regulation of the trade relations between European States prior to the foundation of the European Communities and within the European Union. Before the foundation of the European Communities the trade relations between European States were mostly regulated by bilateral trade agreements. Further liberalization of the trade relations depend on the integration processes, such as foundation of the European Coal and Steal Community, the European Economic Community, the European Internal Market, Custom Union and the European Union (EU).
The second chapter deals with legal aspects of the trade relations within the EU. It is pointed out that the basis of such relations is one of fundamental freedoms of the EU Internal Market, namely the free movement of goods. That is why the main accent in the dissertation is made on scope and framework of this freedom. Greater attention is paid to the investigation of factors, which could restrict this freedom: customs duties, taxation, quantitative restrictions and measures of equivalent effect, activity of state monopolies of a commercial character, and state aid. The complex analysis of the EU precedent law gave the possibility to make classification of member-states’ measures, which are prohibited in their mutual trade relations and to widen the exceptions of free movement of goods.
The third chapter is dedicated to the legal regulation of trade between Ukraine and the EU and perspectives of its development. The legal basis of the trade relations is the Partnership and Cooperation Agreement; the analysis thereof gave an opportunity to determine the main regimes in trade between parties (including special trade regimes in separate sectors), protective measures and procedure of their application. As to the the perspectives of the legal regulation of trade between the EU and Ukraine, the author links them to the participation of Ukraine in the World Trade Organization, the foundation of a free trade area between EU and Ukraine, adaptation of Ukrainian legislation in sphere of trade to the norms and principles of the EU law, enlargement of the EU.
In conclusions the results of the dissertation which characterize the special features of the legal regulation of the trade relation within the European Union as well as between the European Union and Ukraine are generalized.
